Are you a real estate agency?

No. Goodwill Property is a lawyer-supervised real estate service operated through Goodwill Law, an incorporated law firm. As opposed to a licensed Real Estate Agency.
Under New Zealand law, lawyers and incorporated law firms can carry out real estate agency work under the lawyer exemption in the Real Estate Agents Act 2008. That means our property team can help vendors sell their home, with the process supervised by experienced property lawyers.
We are not trying to replicate the traditional agency model. Goodwill Property has been created to offer a more connected property sale service, where the real estate process and legal process work together from the beginning.
Do I still need a separate lawyer?

For a standard sale, no separate standard conveyancing fee is payable because that work is included in the sale fee. In some cases, additional or independent legal advice may be required, including where there is a conflict, dispute, relationship property issue, trust issue, or non-standard matter.
Do your property staff give legal advice?

Legal advice is provided by Goodwill Law’s lawyers. Property staff work under lawyer supervision as part of the overall process.
What does lawyer-supervised mean?

It means the sale process is connected with experienced property lawyers from the beginning, helping ensure contracts, conditions and settlement requirements are handled accurately.
Our professional sale fee includes the standard work required to market, negotiate, document and complete a straightforward property sale, including standard conveyancing through Goodwill Law.
Separate third-party costs are charged in addition. These may include marketing expenses such as photography, Trade Me listings, signboards, floor plans, video, drone or advertising upgrades, and standard conveyancing disbursements such as title searches, LINZ fees, AML verification and other third-party legal costs.
Non-standard legal work may also be charged separately, particularly where additional legal advice, negotiation or dispute resolution is required.
In most straightforward sales, the included standard conveyancing work should be all that is needed to complete the sale.

What makes you different?
You will have a nominated Goodwill Property contact who manages the day-to-day sale process. Goodwill Property is a service of Goodwill Law Limited, and all property sale work is carried out by a lawyer or by a trained team member acting under the supervision of a lawyer. Your engagement documents will identify the person managing your sale and the lawyer with overall responsibility.

If you already have a buyer, we can assist with the next steps, including preparing the agreement, managing key terms and conditions, and completing the standard conveyancing work through Goodwill Law.
Because you may not need the full marketing process, we can discuss the most appropriate fee for the work required. The key benefit is that the sale can still be handled through one connected, lawyer-supervised process — helping ensure the agreement, deadlines, disclosure and settlement are managed properly from the beginning.
